1. Introduction

Modern Waste Solutions, Inc. ("MWS," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect through our website at modernwastesolutions.com (the "Site"), how we use and share it, and the choices available to you.

This policy covers information collected through the Site. It does not cover data contained on devices, drives, or equipment that customers transfer to us for recycling, destruction, or deinstallation. That data is handled under the terms of the applicable service agreement and is addressed separately in Section 12 below.

Your use of the Site is also governed by our Terms and Conditions.

2. Who we are

Modern Waste Solutions, Inc. is an electronics and battery recycling and data destruction company operating since 1999, serving customers throughout California and Northern Nevada. We are the party responsible for the information described in this policy.

3. Information you provide to us

We collect information you submit directly through the Site:

  • Contact and quote forms. Name, business or residential address, email address, phone number, whether you are a business or residential enquirer, and any details you include in the message field.
  • Pickup scheduling requests. Service address, material types and quantities, and site access details you provide.
  • Newsletter subscription. Email address.
  • Direct correspondence. Information contained in emails or phone calls with our team.

4. Information collected automatically

When you visit the Site, certain information is collected automatically by us and by the third-party services described in Section 9:

  • IP address and approximate location derived from it
  • Browser type and version, operating system, device type, and screen resolution
  • Pages viewed, time spent on pages, links clicked, and referring website or search term
  • Date and time of your visit
  • Cookie and advertising identifiers

We also use Google call tracking. When you arrive at the Site through certain Google Ads campaigns, the phone number displayed to you may be replaced with a tracking number so that the resulting call can be attributed to the advertisement. Calls placed to such numbers are connected to our normal business line.

5. Cookies and similar technologies

Cookies are small text files placed on your device. We and our providers use them to keep the Site functioning, to understand how the Site is used, and to support advertising.

  • Strictly necessary. Required for the Site to work, including form submission, security, and bot protection.
  • Analytics. Help us understand which pages are visited and how visitors move through the Site.
  • Advertising. Used to measure advertising performance and to show you our advertisements on other websites and services.

Most browsers let you refuse or delete cookies through their settings. Blocking strictly necessary cookies may prevent parts of the Site, including forms, from working correctly.

6. Analytics and advertising

We run advertising campaigns through Google Ads and measure Site activity using Google Analytics. Tags are managed through Google Tag Manager.

By using the Site, you acknowledge that we run Google Ads campaigns and that information about your visit, including cookie identifiers and pages viewed, is collected and shared with Google for advertising measurement and remarketing. Remarketing means you may see our advertisements on other websites and services after visiting the Site.

You can opt out of personalized Google advertising through Google Ads Settings at adssettings.google.com, and you can prevent Google Analytics from collecting your data using the browser add-on available at tools.google.com/dlpage/gaoptout.

  • To send the newsletter where you have subscribed
  • To operate, secure, and improve the Site, including protecting against spam and automated abuse

  • To keep business records and comply with legal, regulatory, and audit obligations
  • To establish, exercise, or defend legal claims

8. How we share information

We do not sell your personal information for money. We share information in the following circumstances:

  • Service providers. Companies that host the Site, deliver email, process payments, provide analytics and advertising services, and protect the Site from automated abuse. They may use the information only to perform those services for us.
  • Advertising partners. As described in Section 6, cookie and device identifiers are shared with Google for advertising measurement and remarketing. Under California law this may be treated as "sharing" of personal information for cross-context behavioural advertising.
  • Professional advisers and auditors, where necessary and under obligations of confidentiality.
  • Legal and regulatory disclosure, where required by law, subpoena, or a lawful request from a regulator or public authority, or where necessary to protect our rights, safety, or property.
  • Business transfer. In connection with a merger, acquisition, financing, or sale of assets, subject to the terms of this policy.

9. Third-party services on the Site

The Site uses the following third-party services, each of which may receive information about your visit and is governed by its own privacy policy:

  • Webflow hosts the Site and processes form submissions.
  • Google Tag Manager, Google Analytics, and Google Ads provide tag management, analytics, advertising measurement, remarketing, and call tracking.
  • Google Fonts delivers typefaces used on the Site.
  • Google Maps displays our location on the contact page.
  • Google reCAPTCHA and Cloudflare Turnstile protect forms from automated abuse and analyse interaction signals to distinguish humans from bots.
  • Google Business Profile reviews are displayed on the Site, including reviewer names, review text, ratings, and public profile images supplied by Google.
  • Payment processors. Our payment links direct you to pages hosted by third-party processors. Payment card details are entered on their systems, not ours, and we do not receive or store them.

10. Data retention

We keep enquiry and quotation records for as long as needed to respond to you and to maintain business records, and longer where required for tax, accounting, regulatory, or audit purposes. Newsletter subscriptions are retained until you unsubscribe. Analytics and advertising data are retained according to the retention settings of the relevant Google service.

11. Security

We use reasonable administrative, technical, and physical safeguards to protect information collected through the Site, including encrypted transmission and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive information such as account numbers or government identifiers through the Site's forms.

12. Data on equipment we receive

Devices, drives, and equipment transferred to us for recycling, data destruction, or deinstallation may contain data belonging to our customers or to third parties. That data is not collected by us through the Site and is not covered by this policy.

Handling of that data, including destruction methods, chain of custody, certificates of destruction, and the allocation of responsibility between the customer and MWS, is governed by the written service agreement, work order, or quotation applicable to the engagement. Customers remain responsible for their own obligations in respect of data on equipment they transfer to us.

13. Your California privacy rights

California residents may have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to know what personal information we have collected, the sources, the purposes, and the categories of recipients
  • Right to delete personal information we hold about you, subject to legal exceptions
  • Right to correct inaccurate personal information
  • Right to opt out of the sharing of personal information for cross-context behavioural advertising
  • Right to non-discrimination for exercising any of these rights

14. How to exercise your rights

To make a request, contact us at support@modernwastesolutions.com or (916) 339-3676. We will verify your identity before responding, which may require you to confirm information we already hold. An authorised agent may submit a request on your behalf with written permission.

We aim to respond within the timeframes required by applicable law. Some information may be retained where an exception applies, for example where we must keep records for tax, regulatory, or audit purposes.

15. Opting out of advertising sharing

You can opt out of the sharing of your personal information for cross-context behavioural advertising by contacting us using the details above, by adjusting your Google advertising settings, or by using a browser or extension that transmits the Global Privacy Control signal. We treat a Global Privacy Control signal as a valid opt-out request for the browser from which it is sent.

16. Children's privacy

The Site is intended for business and adult use. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us and we will delete it.

17. Third-party links

The Site links to websites we do not control, including payment pages, review platforms, and social media profiles. This policy does not apply to those sites. We encourage you to read their privacy policies before providing information to them.

18. Changes to this policy

We may update this Privacy Policy from time to time. The revised version will be posted on this page with a new effective date. Where changes are significant, we will take reasonable steps to bring them to your attention.
