This notice explains what personal information Modern Waste Solutions ("we," "us," or "our") collects from job applicants, why we collect it, how long we keep it, and the rights California law gives you over it. It applies to anyone who applies for a position with us, whether through our online application, a general application, or a job board. Our general Privacy Policy covers visitors to our website; this notice covers applicants specifically, as required under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).
Categories of personal information we collect
When you apply for a position, we collect:
- Identifiers and contact information — your name, email address, phone number, city, and zip code;
- Application materials — your resume, cover letter, and any answers you provide in the application form, such as how you heard about the role and your work authorization status;
- Role-specific qualifications — for roles that require them, information like CDL class and years of experience;
- Background check results, for roles where one is required — conducted only after a conditional offer of employment has been made, consistent with the California Fair Chance Act; and
- Protected characteristics, only if you choose to volunteer them (for example, veteran or disability status for equal-opportunity reporting purposes) — we never require this information to apply.
We do not use the information you provide for any purpose other than evaluating your application, and we ask that you not include sensitive personal information (such as a Social Security number or financial account numbers) anywhere in your application.
Why we collect it
We use applicant information to:
- evaluate your qualifications and consider you for the position you applied to, and for other open positions;
- communicate with you about your application and, if applicable, your interview and hiring process;
- conduct a background check, where one applies to the role, after a conditional offer of employment;
- comply with recordkeeping and reporting obligations under federal and California law; and
- maintain the security of our hiring process and our business.
How we share it
We do not sell or share (as those terms are defined under the CPRA) applicant personal information. We disclose it only to:
- Service providers who help us run our hiring process — for example, our website and email providers, and, where applicable, a background check provider — who are permitted to use it only to perform those services for us;
- Legal and safety recipients, when we believe disclosure is required by law; and
- Within Modern Waste Solutions, to the hiring team and managers involved in reviewing your application.
How long we keep it
We retain application records, including resumes, for at least 48 months (4 years) from the date of application, consistent with California's Fair Employment and Housing Act record-retention requirements. After that period, applications and their attachments are permanently deleted.
Your California privacy rights
As a California job applicant, the CCPA/CPRA gives you the right to:
- know what personal information we have collected about you and why;
- request deletion of your personal information, subject to legal exceptions (for example, records we must keep for recordkeeping or legal compliance);
- correct inaccurate personal information we hold about you; and
- be free from discrimination or retaliation for exercising these rights.
To exercise any of these rights, contact us using the details below. We will verify your request before responding.
